These Terms of Service ("Terms") govern your use of Merge Market Rush ("the App", "we", "us", or "our"), an Android merge-and-serve market puzzle game developed by Onur Akçakavak.

By downloading, installing, accessing, or using the App, you agree to these Terms. If you do not agree, do not use the App.

1. Use of the App

You may use Merge Market Rush for personal, non-commercial entertainment purposes on Android-powered devices, subject to these Terms, applicable laws, Google Play policies, and any platform terms that apply to your device or account.

In the game, you merge matching goods, serve customer orders, earn progress, unlock collections, and play campaign, Daily Order, or Endless Rush modes where available.

2. No Account or Developer Server

The App does not require a separate in-app account. We do not operate an Onur-controlled gameplay server, player profile database, chat system, leaderboard server, or cloud save backend for the App.

Some features, including purchases, device backups, reviews, ads, consent forms, and store-related services, may depend on your Google account, Google Play, device settings, network availability, or third-party services.

3. Local Progress

Gameplay progress, settings, currency, collections, and No Ads state may be stored locally on your device. If you uninstall the App, clear app data, change devices, or disable platform backup, some local progress may be lost.

4. In-App Purchases

Merge Market Rush may offer optional in-app purchases through Google Play Billing. The current purchase flow is for a non-consumable No Ads entitlement.

All purchases are processed by Google Play. Pricing, taxes, payment methods, refunds, purchase authentication, and purchase history are handled according to Google Play's terms and policies.

No Ads disables interstitial advertising in the App. Rewarded ads may remain available because they are optional player rewards. The App does not use paid loot boxes, paid gacha, or paid random rewards.

Except where required by law or Google Play policy, purchases are final and non-transferable. If a purchase fails, is refunded, reversed, or found to be fraudulent, related in-app benefits may be removed or disabled.

You are responsible for managing device restrictions, family settings, passwords, and purchase approvals on your Google account.

5. Advertisements

The App may display advertisements where ad services are configured and available. Advertising is provided through Google AdMob / the Google Mobile Ads SDK, and may also be provided through Unity LevelPlay (ironSource) mediation with participating advertising networks such as Unity Ads when that runtime is configured.

Interstitial ads, where enabled, are intended for eligible level transitions rather than active mid-shift play. Rewarded ads are optional; you choose whether to watch them for a benefit. If an ad is unavailable, the game should continue without requiring an ad view.

We are not responsible for the content, availability, claims, products, services, or privacy practices of third-party advertisements or external websites linked from ads. If you believe an ad is inappropriate, misleading, broken, or harmful, you may report it through the App where available or contact us by email.

6. Privacy

Your use of the App is also governed by our Privacy Policy. The Privacy Policy explains what information may be stored locally, processed by platform services, or handled by third-party advertising, billing, and consent providers.

7. Intellectual Property

Merge Market Rush, including its game design, code, artwork, user interface, text, levels, branding, and other content, is owned by Onur Akçakavak or used with permission, except for third-party materials owned by their respective owners.

You do not receive ownership rights in the App. You receive a limited, revocable, non-exclusive, non-transferable license to use the App for personal entertainment in accordance with these Terms.

You may share screenshots, gameplay clips, or commentary for personal, editorial, or community purposes, provided that you do not misrepresent ownership, imply endorsement, or use Merge Market Rush assets in a harmful, unlawful, or misleading way.

The "Merge Market Rush" name, logo, and related brand assets may not be used to suggest affiliation, sponsorship, or endorsement without permission.

8. Updates and Changes

We may update, modify, suspend, or discontinue any part of the App at any time. Updates may add, change, rebalance, or remove features, levels, advertisements, purchase options, or compatibility with certain devices.

We may also update these Terms from time to time. If we make material changes, we will update the "Last Updated" date above and, where appropriate, provide notice through the App, store listing, or another reasonable method. Continued use of the App after changes means you accept the updated Terms.

9. Availability and Device Compatibility

We try to keep the App available and functional, but we do not guarantee uninterrupted operation, compatibility with every device, continued availability in every region, or that all issues will be fixed.

The App may depend on Google Play, device hardware, operating system features, network availability, advertising providers, billing systems, consent systems, and other third-party services.

10. User Conduct and Fair Play

You agree to use the App fairly and lawfully. We may disable features, deny support, or take other reasonable steps if we believe the App is being misused, manipulated, tampered with, or used in violation of these Terms.

11. Third-Party Services

The App may integrate third-party services for advertising, billing, consent management, platform compatibility, and distribution. These services are governed by their own terms and policies. We are not responsible for third-party services outside our control.

12. Children and Family Use

Merge Market Rush is designed as a general-audience puzzle game. Parents and guardians are responsible for supervising children's use of devices, managing purchase permissions, and configuring parental controls or family settings where appropriate.

13. Disclaimer of Warranties

To the maximum extent permitted by applicable law, the App is provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

We do not guarantee that the App will be error-free, secure, uninterrupted, compatible with every device, preserve local progress indefinitely, or be available at all times.

14. Limitation of Liability

To the maximum extent permitted by applicable law, Onur Akçakavak will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of data, profits, revenue, goodwill, or device functionality arising from or related to your use of the App.

Where liability cannot be excluded, it is limited to the amount you paid for the App or applicable in-app purchase giving rise to the claim, or the minimum amount permitted by applicable law.

15. Indemnity

You agree to indemnify and hold harmless Onur Akçakavak from claims, losses, liabilities, damages, costs, and expenses arising from your misuse of the App, violation of these Terms, or violation of applicable law or third-party rights.

16. Termination

You may stop using the App at any time by uninstalling it. We may suspend or terminate access to features where reasonably necessary to protect the App, comply with law, enforce these Terms, prevent fraud or abuse, or respond to platform requirements.

Sections that by their nature should survive termination will survive, including intellectual property, disclaimers, limitation of liability, indemnity, governing law, and dispute terms.

17. Governing Law

To the extent permitted by applicable law, these Terms are governed by the laws of the Republic of Türkiye, without regard to conflict-of-law principles.
